1) Acceptance of these Terms
By accessing or using this website, contacting us, submitting a form, using our chat/AI assistant, or engaging with IDX property search features (collectively, the “Site”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site.
2) Who may use the Site
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. You agree to use the Site only for lawful purposes and in compliance with all federal, state (including Arizona), and local laws.
3) Real estate disclosures (no agency until agreed)
Use of this Site and contacting us does not create a broker-client or agency relationship. Any agency relationship will be formed only after you and RW Realty Brokers enter into a written agreement as required by applicable law. We are an equal housing opportunity broker and comply with fair housing laws.
4) Informational nature; not advice
All information on the Site (including property information, market data, articles, or tools) is provided for general information only and is not legal, tax, financial, or other professional advice. You should consult appropriate professionals for advice tailored to your situation.
5) Property listings, IDX & MLS notices
Property data may be provided via an IDX feed from participating MLSs and brokerages. Such data is deemed reliable but not guaranteed and may change without notice. Availability, prices, and features are subject to change; properties may sell or be withdrawn.
Required MLS/IDX attributions and notices (including logos, copyright lines, and “as-is” data statements) will be displayed where applicable.
6) User accounts & submissions
If you create an account, saved search, or alerts, you must provide accurate information and keep credentials confidential. You are responsible for activity under your account.
If you submit content (messages, reviews, forms), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content to operate and improve the Site and our services. You represent you own or have rights to what you submit and that it does not infringe others’ rights.
7) Permitted and prohibited uses
You agree not to:
-Scrape, harvest, index, or data-mine the Site or listings other than through permitted Site features;
-Circumvent access controls, introduce malware, or interfere with Site operation;
-Use the Site to transmit unlawful, harassing, defamatory, or infringing material;
-Misrepresent your identity or affiliation.
We may suspend or terminate access for any violation.
8) Communications consent; call recording
By providing your contact information and submitting a form, you consent to receive calls, emails, and text messages from us about real-estate services. Message/data rates may apply; message frequency varies; consent is not a condition of purchase. Reply STOP to opt-out of SMS at any time and HELP for help. We may provide a recorded or verbal notice when calls are recorded; do not continue with a call if you do not consent to recording where required by law. See our Privacy Policy for details.
9) Intellectual property
The Site, including text, images, logos, design, and underlying software, is owned by or licensed to RW Realty Brokers and is protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, revocable license to access and use the Site for personal, non-commercial purposes. All rights not expressly granted are reserved.
10) Third-party services & links
The Site may integrate third-party tools (e.g., analytics, CRM, scheduling, chat/AI assistant) and link to third-party websites. Those are governed by their own terms and privacy policies. We are not responsible for third-party content, availability, or practices.
11) Accessibility

12) Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RW REALTY BROKERS AND ITS OFFICERS, AGENTS, AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA, OR GOODWILL) ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SITE SHALL NOT EXCEED $100.
14) Indemnification
You agree to indemnify, defend, and hold harmless RW Realty Brokers and its officers, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected to your misuse of the Site, your content, or your violation of these Terms or applicable law.
15) Privacy
Your use of the Site is also governed by our Privacy Policy, which explains what we collect and how we use it, including cookies/analytics, SMS consent, AI assistant interactions, and IDX data.
16) Changes to the Site or Terms
We may update the Site and these Terms from time to time. Updates are effective when posted with a new effective date. Your continued use of the Site after changes are posted constitutes acceptance.
17) Governing law; venue
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of state and federal courts located in Maricopa County, Arizona for any dispute not subject to arbitration (if arbitration is enabled below).
18) Dispute resolution (optional arbitration—tell us if you want this enabled)
If enabled, the following applies:
-Binding Arbitration: Any dispute arising from these Terms or the Site will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
-Class Action Waiver: Disputes will be arbitrated only on an individual basis; class actions and class arbitrations are not permitted.
-Opt-Out: You may opt out of arbitration within 30 days of first use by sending written notice to [email protected].

19) Termination
We may suspend or terminate access to the Site at any time, with or without notice, for conduct that we believe violates law or these Terms or is harmful to other users, us, or third parties.
20) Severability; entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and RW Realty Brokers regarding Site use and supersede prior or contemporaneous understandings on that subject.
